Terms of service

These terms govern your use of HealthDeed. Two sections matter more than the rest: what our reports are and are not, and your agreement not to rely on one by itself. Please read those even if you skip everything else.

Who you are agreeing with

These terms are a binding agreement between you and Abdullah Hassan, trading as HealthDeed (“HealthDeed”, “we”, “us”).

You accept these terms by submitting an address, viewing a report, creating an account, or completing a purchase — whichever happens first. If you do not agree, do not use the service. You must be at least 18 and able to enter a binding contract. If you use HealthDeed on behalf of an organisation, you confirm you are authorised to bind it.

What HealthDeed is

HealthDeed is an automated screening tool. We collect records published by government agencies — the EPA, FEMA, CDC, USGS, NOAA and the U.S. Census among them — and organise them into a report and a score for an address you give us. Every figure in a report names its source and the date we retrieved it.

What HealthDeed is not

A HealthDeed report is informational only. It is not medical, legal, environmental, engineering, financial or real estate advice, and using it creates no professional relationship.

A HealthDeed report is not, and must not be relied on as:

• a home, building or property inspection;
• a Phase I or Phase II Environmental Site Assessment, or any assessment meeting ASTM E1527 or the EPA’s All Appropriate Inquiries standard;
• an appraisal, survey, title search or lien search;
• a test, sample or measurement of any kind taken at the property;
• a determination that a property is safe, healthy, habitable, or free of any hazard;
• a substitute for inspection, laboratory testing, or professional consultation.

We do not visit, enter, inspect, test or sample any property. We do not measure the air inside a building, test its water, inspect its materials or examine its construction. Everything we report comes from third-party public records about the surrounding area and, where available, the parcel.

Absence of a finding is not evidence of absence

A report showing no finding for a hazard means only that the records we searched did not show one. It does not mean the hazard is absent. Public records are incomplete, and many hazards — radon, lead paint, asbestos, mould and indoor air quality among them — cannot be determined from public records at all, and can only be established by testing the specific property.

Coverage varies, and every report says so

We do not assess every hazard for every address. Each report states how much of the hazard set it was able to assess. Categories we could not score are shown as unscored, not as favourable. A score reflects only the categories that were scored.

Resolution

Much of the underlying data is published per census tract, county, ZIP or state, not per property. Where that is so, the value is identical for every address in that area and is not a measurement of your property. Our published methodology sets out which inputs carry which resolution.

Accuracy, third-party data, and no warranty

We report what the agencies publish. We do not independently verify it, we cannot correct it, and we do not control it. Government data is frequently incomplete, out of date, superseded, coarser than a single property, or wrong. Some sources are not updated in real time; some are revised retroactively.

Geocoding — turning an address into a location — is approximate, and can place a property on the wrong side of a boundary such as a flood zone or a water system service area.

A score is an interpretation of records under a published methodology, not a measurement. Reasonable people could weigh the same records differently. Our weightings are choices, not scientific constants.

The service and all reports are provided “as is” and “as available”, without warranty of any kind, express, implied or statutory. To the maximum extent permitted by law we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that reports will be accurate, complete, current, reliable, uninterrupted or error-free. We make no warranty whatsoever regarding data obtained from third-party sources, and we are not responsible for their acts, omissions, errors, delays, outages or discontinuation.

Your responsibilities, and your agreement not to rely

You agree not to rely on a HealthDeed report as the sole or primary basis for any decision — including any decision to buy, sell, lease, finance, insure, improve, occupy or vacate a property, and any health or safety decision.

You agree that before acting on anything in a report you will obtain independent professional inspection, testing or advice appropriate to the matter, and that where a report identifies something of concern the right response is a specific test or a qualified professional, not reliance on our score. You assume all risk arising from your use of the service and from any decision informed by it.

No third-party reliance

Reports are prepared solely for the person who requested them. No other person or entity may rely on a HealthDeed report for any purpose. That includes any buyer, seller, landlord, tenant, agent or broker, lender, insurer, appraiser, inspector, attorney or government body who receives a report from you or through a share link.

If you share a report, including by creating a share link, you do so at your own risk and remain responsible under these terms for how the recipient uses it. We owe no duty of any kind to any recipient.

Acceptable use

You agree not to:

• use a report for any purpose governed by the Fair Credit Reporting Act. HealthDeed is not a consumer reporting agency and its reports are not consumer reports. Reports must not be used as a factor in decisions about credit, insurance, employment, tenancy, or any other FCRA-regulated purpose;
• use the service to make or support any decision that discriminates on the basis of race, colour, religion, sex, familial status, national origin, disability or any other protected characteristic, or to evaluate or classify neighbourhoods for any such purpose;
• use the service to harass, profile, investigate or make determinations about an identifiable individual;
• scrape, crawl, bulk-download or systematically extract reports or data, or access the service by automated means;
• resell, sublicense, republish or redistribute reports, or present them as your own product or another party’s;
• remove, obscure or alter any source citation, date, disclaimer, limitation or coverage statement in a report;
• reverse engineer the service or attempt to derive our methodology, data sets or source code beyond what we publish;
• interfere with the service, or access any account, system or data you are not authorised to access.

The HealthDeed assistant

Where it is available, the assistant answers questions about a report and about buying a home. Its answers are generated by an artificial intelligence model provided by OpenAI. They can be wrong, incomplete or out of date, even when they cite a source. The assistant is not an inspector, appraiser, lawyer, lender or medical professional, and its answers are not professional advice or a verification of any property. Everything in the sections on what HealthDeed is not, accuracy and no warranty, and your agreement not to rely applies to the assistant’s answers in full.

The assistant may search the public web when that gives a more accurate answer. Web pages are written by third parties we do not control; a cited page is a lead to check, not a confirmed fact. Prices, listings and sale histories found this way may be stale or belong to a different unit. We have no access to multiple listing services.

The assistant cannot change a score. A score changes only when connected official records change and a new report is generated; the earlier report is kept. To use the assistant you agree to your questions and the relevant report evidence being sent to OpenAI to generate answers, as described in the privacy policy. Do not include personal, financial or health information about yourself or others in a question.

Usage of the assistant may be limited by an allowance. We may pause the assistant, or web research within it, at any time, including to review costs or a fault. A request that does not finish cleanly is not charged twice.

Your account

You are responsible for the email address you sign in with and for anything done through your account. Tell us promptly if you think someone else has access to it.

Payment, subscriptions and free access

Where a price is shown for a single report, it is a one-time purchase for one address. Payment is handled by Stripe; we do not receive or store your card details. Your purchase includes regenerating that address’s report at no extra cost when the underlying records change.

Monthly plans

Monthly plans are not yet on sale. When they are, these terms apply to them:

• A plan renews automatically every month at the price shown when you subscribed, and you will be charged on each renewal date until you cancel. Before you subscribe we will show the price, what the plan includes, the renewal date and how to cancel.
• You can cancel at any time from your account, online, without contacting us. Cancelling stops the next renewal; you keep access until the end of the period you have paid for, and you are not charged again.
• We will email you at least 30 days before a price increase takes effect for your plan, so you can cancel before it applies.
• A plan’s report and assistant allowances reset each period and do not carry over. Reports you generated stay available after you cancel.
• Charges for a period that has started are covered by the Refunds section below; we do not refund part of a month except in the cases listed there or where the law requires it.

We may make reports available at no charge. These terms apply in full to free, promotional, demonstration and trial access — in particular the sections on what HealthDeed is not, accuracy and no warranty, your agreement not to rely, third-party reliance, and limitation of liability. Free access is provided with no commitment as to availability, accuracy or continuity and may be changed or withdrawn at any time without notice.

Refunds

A report is a digital product delivered immediately and in full at the moment of purchase. Once the report has been generated, all sales are final. We do not offer refunds for change of mind, for findings you disagree with, because a report showed fewer findings than you expected, or because a source was unavailable and a category went unscored.

We will issue a refund in three cases, within 14 days of purchase:

• the report failed to generate and we could not produce it;
• you were charged more than once for the same address;
• the purchase was not authorised by you.

Requests go through the contact form. A refund is made to the original payment method. This section does not limit rights you have under applicable law that cannot be waived.

Limitation of liability

To the maximum extent permitted by law:

Excluded damages. We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages; for lost profits, revenue, data or opportunity, or business interruption; for any diminution in property value, or cost of remediation, repair, testing, inspection or relocation, or loss on any transaction; or for personal injury or illness — regardless of the theory of liability and even if we were told such damages were possible.

Cap. Our total aggregate liability for all claims arising out of or relating to the service or these terms will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars (US$100).

Essential purpose. These limits apply even if a limited remedy is found to have failed of its essential purpose, and they survive termination.

What is not excluded. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, or any other liability that cannot be excluded under applicable law. Some jurisdictions do not allow certain exclusions, in which case they apply as far as the law permits and the rest stays in force.

Indemnification

You will indemnify and hold harmless HealthDeed and its owner, employees and contractors from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your use of the service, your breach of these terms, any decision made by you or a third party in reliance on a report, your sharing of a report, or your violation of any law or third-party right.

Resolving disputes

Before filing anything, you agree to contact us through the contact form and try in good faith to resolve the dispute for at least 30 days.

Any claim must be brought within one year after it arises, or it is permanently barred, to the extent that limit is enforceable where you are.

Changes, suspension and ending the agreement

We may change these terms. Material changes will be reflected in the version and date above, and we will notify account holders by email. Continuing to use HealthDeed after that date is acceptance. We keep dated copies of every published version.

We may suspend or end access for breach of these terms. You may stop using HealthDeed and delete your account at any time. The sections on what HealthDeed is not, accuracy and no warranty, your agreement not to rely, third-party reliance, acceptable use, limitation of liability, indemnification and resolving disputes survive termination.

General

Severability. If any provision is held unenforceable it will be modified to the minimum extent needed to make it enforceable and to give maximum effect to its original intent; if that is not possible it is severed and the rest stays in force.

No waiver. Failing to enforce a provision does not waive it. Assignment. You may not assign these terms; we may, in connection with a sale of the business or its assets. Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including the unavailability, modification or discontinuation of any third-party data source. Entire agreement. These terms, with our privacy policy, are the entire agreement between us and supersede all previous versions.
